GENERAL TERMS & CONDITIONS

Welcome to Your Noble Notary. By using our California Apostille and Certified Translation services, you agree to the following terms. We have designed these to be transparent and fair, ensuring you know exactly what to expect as we process your important documents.

 

1. Our Role as Your Filing Agent

     We act as a professional intermediary between you and government agencies (such as the California Secretary of State). Our       service includes document review, physical transport, filing, and status monitoring. We are not a government agency and do           not have the authority to "grant" an apostille, that power rests solely with the Secretary of State.

2. Processing Times & Government Delays

  • Estimates: Any timeline provided (Standard, Expedited, Next Day) is our best estimate based on current government office volume.

  • No-Guarantee Clause: Because government agencies may experience unexpected backlogs, staffing shortages, or system outages, we cannot strictly guarantee a specific return date.

  • Commitment: While we cannot control the government’s speed, we do guarantee that your documents will be submitted to the correct office within the timeframe promised by your selected service tier.

3. Client Responsibility for Documents

To ensure a smooth process, you are responsible for:

  • Document Eligibility: Ensuring your document is an original or a certified copy that meets California’s requirements (e.g., vital records must be county-certified).

  • Information Accuracy: Providing the correct destination country.

  • Notarization: Ensuring any notarized documents have the correct California-compliant notary wording.

4. Certified Translation Services

  • Accuracy: Our translations are literal and certified for official use.

  • Review Period: Once your translation is complete, you have 48 hours to review it for any clerical errors (such as the spelling of names or addresses) before the final version is apostilled.

5. Fees and Refund Policy

  • Government Fees: Once we pay the filing fees to the State of California or a Consulate on your behalf, these fees are non-refundable.

  • Service Fees: If you cancel your order after we have begun reviewing or preparing your documents but before they are filed, a 50% administrative fee will be retained.

  • Rejected Documents: If the Secretary of State rejects a document due to an error in the original document (e.g., an invalid signature or outdated certificate), our service fee remains non-refundable as the work of filing was completed.

  • Please note that the rates listed on our website serve as a starting point. To ensure you receive the most accurate quote, your final rate is customized based on the travel distance to your specific location from our main service area in Monterey Park (91754). We will provide your exact total as soon as we confirm your meeting address.

6. Protection of Your Documents (Limitation of Liability)

We handle your documents with the highest level of care. However:

  • Physical Loss: If a document is lost or damaged while in our possession, our liability is limited to the replacement cost of that physical document (i.e., the cost of ordering a new certified copy).

  • Third-Party Couriers: We are not responsible for delays or losses caused by FedEx, UPS, or the USPS.

  • Consequential Loss: We are not liable for secondary losses such as missed travel dates, lost business opportunities, or legal deadlines resulting from document delays.

7. Cancellations and Reschedules

  • Services are non-refundable once paid unless canceled in writing at least 24 hours prior to the appointment.

  • Reschedules must be requested at least 12–24 hours prior, depending on service type.

  • Late cancellations or no-shows are subject to full payment unless otherwise agreed.

8. Indemnification

     Clients agree to indemnify and hold harmless Your Noble Notary, its affiliates, and contractors from any claims, liabilities, or               damages arising from misuse of services, violation of these terms, or inaccurate/fraudulent information.

9. Money Back Guarantee

     We are committed to providing accurate, professional, and ethical services across all notarizations, apostille, and translation           requests. If we make an error within our scope of work that directly causes your request to be rejected, we will correct the issue       at no additional service charge or provide a refund of our service fee.

 

     Because many services involve third-party agencies, government offices, and client-provided information, refunds cannot be         issued for delays, denials, or outcomes caused by incorrect documents, incomplete information, client changes, or agency             decisions beyond our control. Government fees and third-party costs are non-refundable.
